Terms of Service
These terms govern your use of cafecitotech.com, the CafecitoTech client platform at app.cafecitotech.com, and any SMS, RCS, voice or chat communications you have with CafecitoTech (“we”, “us”). By using our website or services, or by opting in to our messaging, you agree to these terms.
1. Our services
CafecitoTech designs, builds and operates business automation: AI voice agents, SMS/RCS messaging, web chat, scheduling, websites, apps and process integration. Specific deliverables, pricing and timelines for client work are set out in a separate written proposal or agreement, which controls if it conflicts with these terms.
2. SMS & RCS messaging program
- Program description: conversational and transactional messages from CafecitoTech, including replies to your inquiries, appointment confirmations and reminders, and account or service notices.
- Opt-in: you consent to receive messages by submitting our contact form with your phone number, texting us first, or agreeing in writing. Consent is not a condition of purchase.
- Message frequency varies by conversation. Message and data rates may apply.
- Opt-out: reply STOP at any time to cancel. You will receive one confirmation message and nothing further.
- Help: reply HELP or email [email protected].
- Carriers are not liable for delayed or undelivered messages.
3. Acceptable use
You agree not to use our website, platform or messaging to send unlawful, abusive, deceptive or unsolicited content; to interfere with or attempt to gain unauthorized access to our systems; or to violate carrier, CTIA or applicable messaging rules. We may suspend access for violations.
4. Client accounts
If you have an account on our platform, you are responsible for keeping your credentials confidential and for activity under your account. You must have proper consent from your own customers before we send messages or place calls on your behalf.
5. Intellectual property
Our website, brand, software and content are owned by CafecitoTech or our licensors. Work we build for clients is governed by the applicable client agreement. We believe in no lock-in: ownership and portability of your deliverables are described in your proposal.
6. Disclaimers & limitation of liability
Our website and messaging are provided “as is”. To the fullest extent permitted by law, CafecitoTech is not liable for indirect, incidental or consequential damages arising from your use of the website or messaging programs. Nothing here limits liability that cannot be limited under applicable law.
7. Governing law
These terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-law rules. Disputes will be handled in the state or federal courts located in Miami-Dade County, Florida.
